1. Introduction and Acceptance

Welcome to LifeKeeper, a digital memorial and legacy preservation platform ("Platform") operated by LifeTrace Technologies ("LifeTrace," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Platform, including our website, mobile applications, and QR code services.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use immediately.

2. Key Definitions

Term Definition
Platform The LifeKeeper website, mobile app, QR services, and all related tools and services, owned and operated by LifeTrace Technologies.
User Any person accessing or using the Platform, including Memorial Owners, Company Handlers, and Visitors.
Memorial Owner The individual who creates, registers, and holds the primary administrative rights for a Memorial Page.
Visitor Any User who accesses and views a Memorial Page, typically by scanning a QR code or following a link, without having editing or management rights.
Company Handler An individual authorized by a Partner Company (e.g., a tombstone vendor or funeral home) to manage that company's account, content, and client memorials on the Platform.
Memorial Page The digital profile created for a deceased individual, containing Memorial Content.
Memorial Content All text, images, videos, biographies, tributes, and other data uploaded by a User to a Memorial Page.

3. Eligibility and User Types

3.1. Eligibility

You must be at least 18 years old to create, manage, or edit a Memorial Page or act as a Company Handler. Visitors may be of any age, provided they comply with these Terms.

3.2. Memorial Owners

Memorial Owners must confirm they have the necessary legal and family authority or consent to create and manage the Memorial Page, as detailed in the Memorial Ownership & Family Consent Agreement.

3.3. Company Handlers

Company Handlers are responsible for managing the content, client data, and all activities associated with their Partner Company's account on the Platform. Company Handlers are solely responsible for ensuring that all content uploaded on behalf of their clients complies with these Terms and all applicable laws.

3.4. Visitors

Visitors are granted a limited, non-exclusive, non-transferable right to view Memorial Pages made public by the Memorial Owner. Visitors agree not to copy, reproduce, or redistribute any Memorial Content without explicit permission.

4. User Responsibilities and Prohibited Conduct

4.1. User License and Prohibited Use

LifeTrace Technologies grants you a limited, non-exclusive, non-transferable license to access and use the Platform solely for your personal, non-commercial memorialization purposes.

You are expressly prohibited from:

  • Using any robot, spider, web crawler, extraction software, or any other automated process or device to scrape, copy, or monitor any portion of the Services or any information, content, or material from the Services.
  • Re-publishing, transmitting, displaying, performing, reproducing, reselling, licensing, creating derivative works from, transferring, or selling any information, content, material, software, products or services obtained through the Service.
  • Creating or maintaining a Memorial Page for any commercial purpose or intent, including but not limited to acquiring a website name or URL for resale or rental, or linking to any commercial website from a Memorial Page without prior written consent from LifeTrace Technologies.

4.2. Prohibited Content

In addition to the general prohibitions, Users may not upload, link to, or display any Memorial Content that:

  • Contains vulgar, profane, abusive, hateful, or sexually explicit language, epithets or slurs, text or illustrations in poor taste, inflammatory attacks of a personal, sexual, racial or religious nature, or expressions of bigotry, racism, discrimination or hate.
  • Is defamatory, threatening, disparaging, inflammatory, false, misleading, deceptive, fraudulent, inaccurate, or unfair, contains gross exaggeration or unsubstantiated claims, or violates the privacy rights or right of publicity of any third party.
  • Is intended primarily to promote a cause or movement, whether political, religious or other, without prior consent.
  • Constitutes, promotes or encourages illegal acts, the violation of any right of any individual or entity, or otherwise creates liability.
  • Infringes any copyright, trademark, patent, trade secret, or other intellectual property right.

LifeTrace Technologies reserves the right to remove any content that violates these rules without prior notice.

5. Content Ownership and License

5.1. Ownership

You retain all ownership rights to the Memorial Content you upload.

5.2. License Grant

By uploading Memorial Content, you grant LifeTrace Technologies, its affiliates, and related entities a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, copy, display, archive, store, publish, transmit, perform, distribute, reproduce and create derivative works from all Material you provide, solely for the purpose of operating, promoting, and improving the Memorial Page and the Platform.

6. Payments and Services

Certain premium features, such as enhanced QR plaques, extended storage, or specific vendor services, may require payment. All fees are non-refundable unless explicitly stated otherwise in a separate written agreement.

7. QR Code Usage

QR codes provided by LifeKeeper are unique identifiers for a Memorial Page.

No Liability for Physical Damage:

LifeTrace Technologies is not liable for any damage, misprinting, or alteration of physical QR plates or engravings caused by external vendors, weather, vandalism, or third parties.

No Resale:

QR codes provided for a specific memorial may not be copied, resold, or repurposed for a different memorial.

8. Privacy and Data Protection

LifeTrace Technologies handles all personal data in accordance with its Privacy Policy and applicable laws, including the Data Protection Act (Chapter 11:12) of Zimbabwe. By using the Platform, you consent to the data practices described in the Privacy Policy.

9. Proprietary Rights and Intellectual Property

9.1. Proprietary Rights of LifeTrace Technologies

You acknowledge and agree that the Platform contains proprietary information and content that is protected by intellectual property and other laws. All designs, text, graphics, interfaces, software, and other content used in the Platform are the exclusive property of LifeTrace Technologies or its licensors, and may not be used except as provided in these Terms of Use without advance, written permission of LifeTrace Technologies.

9.2. Copyright Infringement (DMCA-Style Notice)

LifeTrace Technologies respects the intellectual property rights of others and expects its users to do the same. If you believe that any content on the Platform infringes your copyright, you may send us a notice requesting that the content be removed. The notice must comply with the requirements of the Digital Millennium Copyright Act (DMCA) or similar applicable law.

10. Suspension and Termination

LifeTrace Technologies may suspend or terminate any User's account or access to the Platform immediately, without prior notice, if:

  • These Terms are violated, particularly the Prohibited Content or User Responsibilities sections.
  • The User fails to pay any fees when due.
  • A formal, documented dispute regarding Memorial Ownership is received.

11. Limitation of Liability and Disclaimer

The Platform is provided on an "as-is" and "as-available" basis. LifeTrace Technologies makes no warranties, express or implied, regarding the Platform's operation or the Memorial Content.

To the maximum extent permitted by law, LifeTrace Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, resulting from:

  • The use or inability to use the Platform.
  • The conduct or content of any other User, including Memorial Owners, Visitors, or Company Handlers.
  • Loss of data due to user error, internet failure, or hosting downtime.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Zimbabwe. You agree to submit to the exclusive jurisdiction of the courts located in Zimbabwe to resolve any legal matter arising from these Terms.
